1. Introduction
These Terms of Service (“Terms”) govern access to and use of bibisco Everywhere, a subscription-based service that provides cloud synchronization and mobile application access for bibisco users.
By purchasing, subscribing to, accessing, or using bibisco Everywhere, you confirm that you have read, understood, and accepted these Terms.
The service is provided by:
Andrea Feccomandi, trading as bibisco
Via Aldo Moro, 5
40033 Casalecchio di Reno (BO) – Italy
Email: info@bibisco.com
Website: https://bibisco.com
For subscriptions purchased through the bibisco website, Lemon Squeezy acts as Merchant of Record and manages payment processing, billing, invoicing, applicable taxes, and certain refund-related processes.
For subscriptions purchased through the Apple App Store, payment collection, billing, renewal, cancellation, receipts, and refund requests are handled through Apple in accordance with Apple’s applicable terms and policies.
The procedures applicable to billing, renewal, cancellation, and refunds depend on the Sales Channel through which the Subscription was purchased.
These Terms govern the hosted cloud synchronization service and related subscription access. They do not replace or modify any separate software license applicable to the bibisco desktop or mobile applications, except to the extent expressly stated in these Terms.
2. Definitions
For the purposes of these Terms:
- “Provider”, “we”, “us”, or “our” means Andrea Feccomandi, trading as bibisco.
- “User”, “you”, or “your” means the individual or entity accessing or using bibisco Everywhere.
- “bibisco Everywhere” means the subscription service that provides access to cloud synchronization, mobile application functionality, and related hosted services.
- “Software” means the bibisco desktop and mobile applications.
- “Project Data” means the novels, projects, text, notes, characters, timelines, settings, metadata, attachments, and other content created, stored, or synchronized by the user through bibisco.
- “Cloud Data” means Project Data stored on cloud infrastructure for synchronization purposes.
- “Subscription” means the paid or trial-based access plan for bibisco Everywhere.
- “Sales Channel” means the website, payment provider, application marketplace, or app store through which a Subscription is purchased, including Lemon Squeezy, the Apple App Store, Google Play, or another channel made available by the Provider.
- “Merchant of Record” means Lemon Squeezy or another provider appointed to act as the legal seller for transactions made through the bibisco website and to manage payment processing, applicable taxes, invoicing, refunds, chargebacks, and related payment operations.
3. Prerequisites
bibisco Everywhere requires an active installation of bibisco on a desktop device running Windows, macOS, or Linux, whose conditions of sale, installation, and management — those of bibisco, not of bibisco Everywhere — fall outside these Terms.
The mobile application is an extension of the desktop product and is not intended to be used independently as a complete standalone writing application.
You are responsible for ensuring that your devices, operating systems, internet connection, app stores, browser, security software, and local bibisco installation are compatible with bibisco Everywhere.
The Provider does not guarantee that bibisco Everywhere will work on every device, operating system version, network configuration, or third-party environment.
4. What bibisco Everywhere Includes
An active bibisco Everywhere subscription may provide:
- access to the bibisco mobile application for Android and iOS, where available;
- cloud synchronization of projects between desktop and mobile devices;
- cloud storage of synchronized Project Data for synchronization and recovery convenience;
- related account, subscription, and synchronization features made available by the Provider from time to time.
Cloud storage made available through bibisco Everywhere is not a cloud backup service. It is provided for synchronization purposes and convenience only, and is not intended to replace the user’s own independent local, offline, or external backups.
The Provider may add, modify, limit, suspend, or remove specific features of bibisco Everywhere in accordance with these Terms.
5. Subscription Plans, Pricing, and Free Trial
bibisco Everywhere may be available through monthly and annual subscription plans. The plans, prices, currencies, and promotional offers available to a user may vary depending on country, platform, Sales Channel, tax treatment, promotional campaign, or applicable marketplace rules.
Current prices and available plans are displayed by the applicable Sales Channel before the Subscription is purchased.
A 14-day free trial may be available to eligible subscribers, subject to the rules and eligibility requirements of the applicable Sales Channel. No charge is applied during the trial period.
Unless the Subscription is cancelled before the trial expires, it automatically converts into a paid Subscription at the price and billing frequency displayed when the Subscription was started and subsequently renews automatically until cancelled.
For Subscriptions purchased through the bibisco website, payment is processed by Lemon Squeezy, which acts as Merchant of Record and manages payment processing, billing, invoicing, applicable taxes, refunds, chargebacks, and payment-related compliance.
For Subscriptions purchased through the Apple App Store, payment is charged to the user’s Apple Account and payment collection, billing, renewal, receipts, and applicable taxes are administered by Apple in accordance with Apple’s applicable terms and policies.
The final price, currency, applicable taxes, billing frequency, and trial conditions are those displayed by the applicable Sales Channel before the user confirms the purchase.
The Provider may change subscription plans, features, pricing, or promotional offers from time to time. Price changes will apply at renewal or as otherwise permitted by applicable law and the rules of the relevant Sales Channel. Users will be notified of material price changes where required.
6. Renewal, Cancellation, Refunds, and Withdrawal Rights
Subscriptions renew automatically at the end of each billing period until cancelled.
Subscriptions must normally be cancelled through the same Sales Channel through which they were purchased.
For Subscriptions purchased through the bibisco website, cancellation may be completed through the Lemon Squeezy customer portal, the link contained in the purchase confirmation email, or another subscription-management tool made available by the Provider.
For Subscriptions purchased through the Apple App Store, cancellation must be completed through the subscription settings associated with the user’s Apple Account.
Uninstalling the application, ceasing to use bibisco Everywhere, or deleting a bibisco account does not automatically cancel a Subscription managed by a third-party Sales Channel.
Unless otherwise required by applicable law or the rules of the relevant Sales Channel, cancellation takes effect at the end of the current billing period.
Except where required by applicable law or approved by the relevant Sales Channel, Subscription fees are non-refundable and no partial refunds or credits are issued for unused time within a billing period.
For purchases processed by Lemon Squeezy, refund requests are handled in accordance with Lemon Squeezy’s applicable procedures and policies.
For purchases made through the Apple App Store, refund requests must be submitted to Apple and are subject to Apple’s applicable refund policies. The Provider cannot directly issue a refund for a transaction processed by Apple.
6.1 Free Trial Cancellation
If you cancel during the 14-day free trial, you will not be charged, provided that the cancellation is completed in accordance with the procedures and deadlines of the applicable Sales Channel.
If you do not cancel before the trial expires, the Subscription will automatically convert into a paid Subscription at the price and billing frequency displayed when the Subscription was started.
6.2 Consumer Withdrawal Rights
If you are a consumer located in the European Union, European Economic Area, United Kingdom, or another jurisdiction granting mandatory withdrawal rights, you may have a statutory right to withdraw from your purchase within 14 days from the date of conclusion of the contract, unless an exception applies under applicable law.
bibisco Everywhere may include a 14-day free trial that allows eligible users to test the service before being charged. The free trial is a contractual promotional period and is separate from any statutory withdrawal right you may have.
You may cancel during the free trial without being charged, provided that the cancellation is completed before the trial expires and in accordance with the procedures of the applicable Sales Channel.
Nothing in these Terms limits any mandatory withdrawal, cancellation, or refund rights available to you under applicable law.
Where a refund is legally required, it will be handled in accordance with the procedures of the Sales Channel through which the Subscription was purchased. Refunds for purchases made through the bibisco website may be processed by Lemon Squeezy as Merchant of Record. Refund requests relating to purchases made through the Apple App Store must normally be submitted to Apple and are subject to Apple’s applicable procedures and policies.
To exercise a statutory withdrawal right, you may contact us at info@bibisco.com or use the cancellation, withdrawal, or refund tools made available by bibisco or the applicable Sales Channel. Contacting bibisco does not replace any procedure that must be completed directly through Apple or another third-party Sales Channel.
6.3 Refunds, Chargebacks, and Payment Reversals
Refunds, chargebacks, payment reversals, failed payments, fraud reviews, or payment disputes may result in suspension or termination of access to bibisco Everywhere.
The Provider may rely on payment, subscription, refund, fraud-prevention, and chargeback information supplied by the applicable Sales Channel when determining the status of a Subscription.
7. Effects of Cancellation, Expiration, Refund, or Termination
Upon cancellation, expiration, refund, chargeback, or termination of your Subscription:
- access to the mobile application and cloud synchronization features may cease at the end of the current billing period, immediately, or at another time determined by applicable law, the Provider, or the relevant Sales Channel;
- Cloud Data may be retained for up to 30 days for the purpose of reactivation, recovery, technical administration, fraud prevention, legal compliance, or dispute management;
- after that period, Cloud Data may be permanently deleted without further notice;
- Project Data stored locally on your own devices remains accessible through your local bibisco installation, subject to the functionality of the Software, your device, and your local backups.
The Provider has no obligation to maintain, restore, export, recover, or provide access to Cloud Data after the Subscription ends, except where required by applicable law.
Users are solely responsible for exporting, downloading, saving, and backing up their Project Data before cancellation, expiration, or termination.
8. User Responsibilities
You are responsible for:
- maintaining the confidentiality and security of your account credentials;
- ensuring that your devices, operating systems, internet connection, local storage, security software, and bibisco installation are functional and secure;
- keeping independent local, offline, or external backups of your projects;
- ensuring that you have all necessary rights to any Project Data you create, store, upload, or synchronize;
- ensuring that your use of bibisco Everywhere complies with applicable laws and third-party rights;
- promptly notifying the Provider if you suspect unauthorized access, account compromise, data loss, or security issues;
- reviewing synchronized data and local project status to ensure that your projects have been correctly saved and backed up.
You acknowledge that writing projects may be personally, creatively, commercially, or emotionally valuable, and that you remain responsible for protecting them through independent backups.
9. Acceptable Use
You agree not to use bibisco Everywhere to:
- store, transmit, synchronize, or distribute unlawful, infringing, defamatory, abusive, harmful, or malicious content;
- violate intellectual property rights, privacy rights, publicity rights, contractual rights, or other rights of third parties;
- upload or synchronize malware, viruses, ransomware, spyware, harmful code, or content intended to compromise systems or data;
- interfere with, overload, disrupt, reverse engineer, bypass, scrape, probe, scan, or test the vulnerability of the service or related infrastructure without authorization;
- circumvent subscription limits, access controls, authentication systems, technical restrictions, or security measures;
- resell, sublicense, rent, lease, share, or commercially exploit access to bibisco Everywhere without prior written permission;
- use bibisco Everywhere in a way that creates legal, security, operational, reputational, or infrastructure risk for the Provider, other users, Lemon Squeezy, Google Firebase, app stores, or other third-party providers.
The Provider may investigate suspected violations of this section and may suspend or terminate access where reasonably necessary to protect the service, users, third parties, or the Provider.
10. User Content, Ownership, and Limited License
You retain ownership of your Project Data.
By using bibisco Everywhere, you grant the Provider a limited, non-exclusive, worldwide, royalty-free license to host, store, copy, process, transmit, synchronize, secure, back up, restore, and technically manage your Project Data solely for the purpose of providing, maintaining, securing, improving, supporting, and administering bibisco Everywhere, and for complying with legal obligations.
This license exists only to the extent necessary to operate bibisco Everywhere and does not give the Provider ownership of your Project Data.
The Provider does not claim any copyright ownership over your novels, stories, characters, notes, manuscripts, or other creative works.
The Provider does not review, monitor, or moderate Project Data as a general practice, but may access, process, preserve, disclose, or delete data where reasonably necessary to:
- provide technical support requested by the user;
- maintain, secure, debug, or improve the service;
- investigate abuse, fraud, security incidents, or violations of these Terms;
- comply with applicable law, court orders, legal claims, or requests from competent authorities;
- protect the rights, safety, property, or legitimate interests of the Provider, users, or third parties.
11. Cloud Synchronization, Storage, and Backups
bibisco Everywhere provides cloud synchronization and cloud storage of synchronized Project Data for convenience and continuity across supported devices.
Cloud synchronization is not a professional backup, archival, disaster recovery, or data preservation service.
The Provider does not guarantee that Cloud Data will always be complete, current, accurate, recoverable, conflict-free, or available in every circumstance.
Synchronization may fail, be delayed, create conflicts, overwrite data, or be interrupted due to factors including but not limited to:
- internet connectivity issues;
- device failure;
- operating system restrictions;
- user error;
- insufficient storage;
- third-party service outages;
- app store restrictions;
- software bugs;
- authentication problems;
- corrupted local files;
- incompatible software versions;
- failed payments or expired subscriptions;
- security incidents or force majeure events.
You are solely responsible for maintaining independent backups of your Project Data using bibisco’s built-in backup functionality and/or other backup systems under your control.
The Provider is not liable for loss, corruption, deletion, overwriting, unauthorized access, synchronization conflict, or failure to recover Project Data except to the extent liability cannot be excluded or limited under applicable law.
12. Fair Use and Technical Limits
The Provider may apply reasonable technical, operational, or security limits to bibisco Everywhere, including but not limited to limits on:
- storage space;
- bandwidth;
- file size;
- number of synchronized projects;
- number of devices;
- synchronization frequency;
- API calls;
- account activity;
- support requests;
- data retention;
- backup or restore attempts.
These limits may be introduced, modified, or enforced where reasonably necessary to ensure security, reliability, legal compliance, cost control, fair use, or protection of the service.
Excessive, abusive, automated, harmful, or abnormal usage may result in throttling, suspension, termination, data deletion, or additional restrictions.
13. Service Availability and No SLA
The Provider makes reasonable efforts to ensure the availability and reliability of bibisco Everywhere, but does not guarantee uninterrupted, secure, timely, error-free, or loss-free operation.
bibisco Everywhere is provided without any service level agreement, uptime commitment, support response time commitment, recovery time objective, recovery point objective, or service credit, unless expressly agreed in writing.
The service may be unavailable, limited, delayed, or interrupted due to maintenance, updates, technical issues, security incidents, third-party outages, network failures, legal requirements, or events outside the Provider’s reasonable control.
14. Third-Party Services and App Stores
bibisco Everywhere depends on third-party infrastructure, platforms, and services, including but not limited to:
- Google Firebase;
- Lemon Squeezy;
- Apple App Store;
- Google Play;
- device manufacturers;
- operating system providers;
- internet service providers;
- hosting, analytics, security, email, and payment providers.
Use of bibisco Everywhere may also be subject to the applicable terms, policies, technical limitations, and account requirements of those third parties.
The Provider is not responsible for interruptions, limitations, policy changes, account restrictions, outages, bugs, pricing changes, data processing practices, security incidents, or failures caused by third parties outside the Provider’s reasonable control.
If a third-party service becomes unavailable, restricted, modified, discontinued, or commercially unreasonable, the Provider may modify, suspend, replace, or discontinue affected features of bibisco Everywhere.
Subscriptions purchased through an app store or third-party payment provider are also subject to the terms and policies of the applicable Sales Channel. Where required, that Sales Channel’s terms govern payment collection, billing, renewal, cancellation, receipts, and refund procedures.
15. Service Modifications and Discontinuation
The Provider reserves the right to modify, suspend, limit, replace, or discontinue bibisco Everywhere, in whole or in part, at any time.
In the event of material changes or discontinuation of the service, users will be notified via email, website notice, in-app notice, or another reasonable method with a minimum notice period of 30 days, where reasonably possible and where required by applicable law.
No advance notice may be provided where immediate action is necessary for security, legal compliance, fraud prevention, third-party service restrictions, emergency maintenance, or protection of users or infrastructure.
Pricing may be updated at the time of Subscription renewal. Users will be notified of material price changes before they take effect where required by law.
16. Changes to These Terms
The Provider may update these Terms from time to time.
Material changes will be notified by email, website notice, in-app notice, or another reasonable method before they take effect where required by applicable law.
Continued use of bibisco Everywhere after the effective date of updated Terms constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
If you do not agree to the updated Terms, you must stop using bibisco Everywhere and cancel your subscription.
The version of the Terms in effect at the time of your use of the service governs that use, unless otherwise required by applicable law.
17. Suspension and Termination
The Provider may suspend, restrict, or terminate your access to bibisco Everywhere, with or without prior notice, if:
- payment fails;
- the Subscription expires, is cancelled, refunded, reversed, or charged back;
- you breach these Terms;
- you violate applicable law or third-party rights;
- your use creates security, legal, operational, reputational, or infrastructure risk;
- you attempt to abuse, overload, interfere with, bypass, or misuse the service;
- your account is suspected of fraud, unauthorized access, or compromise;
- suspension or termination is required by law, a competent authority, a payment processor, an app store, or a third-party infrastructure provider;
- continued provision of the service becomes technically, legally, commercially, or operationally impracticable.
In case of suspension or termination, the Provider may restrict access to cloud synchronization, mobile features, account features, Cloud Data, and related services.
Local Project Data stored on your own devices remains unaffected by service suspension or termination, unless separately impacted by your device, operating system, local installation, local storage, user actions, or other factors outside the Provider’s control.
Termination or suspension does not entitle you to a refund except where required by applicable law or approved by the applicable Sales Channel.
18. Data and Privacy
The processing of personal data in connection with bibisco Everywhere is governed by the bibisco Privacy Policy.
Cloud synchronization is provided through Google Firebase.
For Customer Personal Data processed through Firebase, Google may act as data processor under the applicable Google Firebase Data Processing and Security Terms. Certain technical, diagnostic, operational, and service-related data may also be processed by Google in accordance with Google’s applicable terms.
Data may be processed or stored outside the European Economic Area. Where required by the General Data Protection Regulation or other applicable data protection laws, such transfers are protected through appropriate safeguards, including Standard Contractual Clauses or other lawful transfer mechanisms.
By using bibisco Everywhere, you acknowledge that cloud synchronization necessarily involves the transmission, storage, processing, and retrieval of Project Data through third-party cloud infrastructure.
You are responsible for ensuring that any Project Data you synchronize complies with applicable data protection, confidentiality, and intellectual property laws.
19. Security
The Provider makes reasonable efforts to protect bibisco Everywhere and Cloud Data against unauthorized access, loss, misuse, or alteration.
However, no cloud service, software system, network, device, encryption method, authentication system, or storage mechanism can be guaranteed to be completely secure.
You are responsible for using strong passwords, protecting your devices, securing your accounts, keeping your operating systems and applications updated, and preventing unauthorized access to your local projects and cloud account.
The Provider is not responsible for unauthorized access, data loss, or damage resulting from compromised credentials, insecure devices, malware, user error, third-party breaches, or circumstances outside the Provider’s reasonable control.
20. Support
The Provider may offer support for bibisco Everywhere through email, website forms, documentation, or other channels made available from time to time.
Support is provided on a reasonable-efforts basis and does not include any guaranteed response time, resolution time, data recovery obligation, custom development, training, migration assistance, or professional services unless expressly agreed in writing.
The Provider may refuse or limit support where requests are abusive, excessive, unlawful, unrelated to bibisco Everywhere, technically impracticable, or outside the scope of the service.
21. Intellectual Property, GPL, and Trademarks
The bibisco desktop and mobile applications may be licensed under the GNU General Public License, as indicated in the applicable software license notices. The GPL applies only to the software code covered by that license.
bibisco Everywhere as a hosted synchronization service, including cloud infrastructure, accounts, subscriptions, server-side components, trademarks, branding, domain names, website content, documentation, commercial access rights, and related hosted functionality, is not licensed under the GPL and is governed by these Terms.
Nothing in these Terms grants you ownership of, or any license to use, the Provider’s trademarks, trade names, logos, branding, domain names, website content, commercial identity, or service marks, except as expressly permitted by law or by prior written permission from the Provider.
The names “bibisco” and “bibisco Everywhere”, related logos, branding, and service identity are trademarks, trade names, or distinctive signs of the Provider and may not be used in a way that creates confusion, implies endorsement, misrepresents affiliation, or harms the Provider’s reputation.
22. Limitation of Liability
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, death or personal injury where caused by negligence, or any liability that cannot be excluded or limited under applicable law.
Subject to the preceding paragraph, bibisco Everywhere is provided “as is” and “as available”, without warranties of any kind, express or implied, including but not limited to warranties of availability, reliability, accuracy, security, compatibility, fitness for a particular purpose, merchantability, non-infringement, or uninterrupted operation.
The Provider makes reasonable efforts to ensure the availability and reliability of the synchronization service, but does not guarantee uninterrupted, error-free, secure, conflict-free, or loss-free operation.
bibisco Everywhere is not intended as a backup service. The user acknowledges that cloud synchronization is provided as a convenience feature and accepts responsibility for maintaining independent local, offline, or external backups of all Project Data.
To the maximum extent permitted by applicable law, the Provider shall not be liable for any loss, corruption, deletion, unauthorized access, disclosure, alteration, overwriting, synchronization conflict, failure to synchronize, failure to restore, or unavailability of Project Data resulting from technical failures, connectivity issues, third-party service interruptions, device failures, software bugs, user error, account compromise, payment issues, or events outside the Provider’s reasonable control.
To the maximum extent permitted by applicable law, the Provider shall not be liable for any indirect, special, incidental, consequential, exemplary, or punitive damages, including but not limited to loss of use, loss of profits, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of data, loss of manuscripts, loss of creative work, business interruption, or emotional distress, whether in contract, tort, negligence, strict liability, or otherwise, arising out of or in any way connected with the use of, or inability to use, bibisco Everywhere.
To the maximum extent permitted by applicable law, the Provider’s total aggregate liability for any direct damages arising out of or relating to bibisco Everywhere shall not exceed the amount paid by the user for bibisco Everywhere in the twelve months preceding the event giving rise to the claim.
Users accessing bibisco Everywhere during the free trial period agree that, to the maximum extent permitted by applicable law, the Provider shall not be liable for any damages of any kind arising out of or relating to the service during the trial. If applicable law does not permit a complete waiver of liability, the Provider’s maximum liability during the trial period shall not exceed €10.
Some jurisdictions do not allow the limitation or exclusion of certain warranties, remedies, or damages, so some of the above exclusions or limitations may not apply to you.
23. Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Provider from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:
- your breach of these Terms;
- your misuse of bibisco Everywhere;
- your violation of applicable law;
- your violation of third-party rights;
- your Project Data;
- unauthorized access caused by your credentials, devices, systems, or negligence;
- claims that your Project Data infringes or violates intellectual property, privacy, confidentiality, publicity, or other rights of third parties.
This section applies only to the extent permitted by applicable consumer protection laws and does not limit any mandatory rights available to consumers.
24. Force Majeure
The Provider shall not be liable for any delay, failure, interruption, data loss, or inability to provide bibisco Everywhere resulting from events beyond the Provider’s reasonable control, including but not limited to:
- outages or failures of third-party services;
- internet or telecommunications failures;
- cyberattacks;
- malware or security incidents;
- natural disasters;
- fire, flood, earthquake, or extreme weather;
- war, terrorism, civil unrest, or public emergency;
- strikes, labor disputes, or supply chain disruptions;
- governmental actions, legal restrictions, sanctions, or regulatory requirements;
- failures, restrictions, or policy changes by app stores, hosting providers, payment processors, cloud infrastructure providers, or device manufacturers.
25. Consumer Rights and Mandatory Law
Nothing in these Terms limits or excludes any mandatory rights that you may have as a consumer under applicable law.
If you are a consumer, provisions of these Terms apply only to the extent permitted by applicable consumer protection laws.
If any provision of these Terms conflicts with mandatory consumer protection law applicable to you, the mandatory law will prevail to the extent of the conflict, and the remaining provisions will continue to apply.
26. Severability
If any provision of these Terms is found to be unlawful, void, invalid, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.
Where possible, the invalid or unenforceable provision shall be interpreted or replaced by a valid and enforceable provision that most closely reflects the original purpose of the provision.
27. Assignment
You may not assign, transfer, sublicense, or delegate your rights or obligations under these Terms without the Provider’s prior written consent.
The Provider may assign, transfer, subcontract, or delegate its rights and obligations under these Terms in connection with a merger, acquisition, reorganization, sale of assets, change of business structure, use of subcontractors, or transfer of the bibisco business, provided that this does not materially reduce your mandatory consumer rights.
28. Governing Law and Jurisdiction
These Terms are governed by the laws of Italy.
To the extent permitted by applicable law, any disputes arising from or relating to these Terms, bibisco Everywhere, or the relationship between the user and the Provider shall be subject to the exclusive jurisdiction of the courts of Bologna, Italy.
Nothing in this clause limits the rights of consumers under applicable mandatory local laws, including the right to bring claims before the courts of their place of residence where required by applicable consumer protection law.
29. Notice of Important Clauses and Specific Approval Where Required
Certain provisions of these Terms may be considered particularly important or restrictive under applicable law, including clauses concerning automatic renewal, cancellation, refunds, suspension, service modifications, technical limits, third-party services, limitation of liability, indemnification, force majeure, assignment, governing law, and jurisdiction.
The user is invited to read these clauses carefully before purchasing, subscribing to, accessing, or using bibisco Everywhere.
Where applicable law requires specific approval of certain clauses, the Provider may request such approval through a separate checkbox, clickwrap confirmation, electronic acceptance flow, written confirmation, in-app confirmation, or another legally valid method.
Where the activation flow, application interface, or account area requires the user to select a separate checkbox or otherwise provide a separate electronic confirmation for the clauses listed in this Section 29, the user specifically approves those clauses to the maximum extent permitted by applicable law.
If a specific approval required by applicable law has not been validly obtained, the relevant clause shall apply only to the maximum extent permitted by applicable law. The absence, invalidity, or unenforceability of a specific approval shall not affect the validity or enforceability of the remaining provisions of these Terms.
For convenience, the clauses that may require particular attention include, without limitation:

- Section 7 — Effects of Cancellation, Expiration, Refund, or Termination;
